Hi guys. Personal injury attorney Scott DeSalvo here.
Have you received a subpoena or a notice of deposition from a law firm in Chicago? Well in today’s video I’m going to answer the question “what is a deposition?”

What is a deposition?

A deposition is a recorded statement usually with a court reporter, where you’re going to go to somebody’s office, either defense lawyers office or a plaintiffs’ lawyers office and all of the lawyers involved in the case are going to be there. There will be a court reporter there as well.

The lawyers will be asking you questions under oath so you have to swear to tell the truth or certify that your answers are the truth. The court reporter will be typing down all the questions and answers that they hear. There are a couple of rules that you need to follow to make sure you get a clear transcript.

The first rule is all of your answers have to be out loud using words. You must use real words instead of “uh-huh” or “uh-uh.”   If the court reporter can’t hear it and understand it, she can’t accurately type it.

There are a couple of other things you need to know, too.

For example if you are subpoenaed for deposition and you don’t respond, you can get in trouble with court. Ultimately you can be held in contempt of court. So you can’t ignore a subpoena.

Another important thing for you to remember is that if you can’t make it on the date that the attorneys provide for you to appear and give your deposition, most attorneys are very flexible.
If you call their office they will reschedule your deposition.

The last thing you need to know about depositions is that the reason well, there’s lots of reasons why attorneys take depositions, but the number one reason that attorneys take depositions is they want to commit you to a story of what happened and what you saw.

So the number one rule of depositions is review the facts before your deposition.

And always tell the truth.

If you always tell the truth, first of all you’re under oath swearing to do so, but if you will always tell the truth you don’t have to remember anything.

Now if you are represented in the case and you do have a right to be represented, obviously your attorney will talk to you before your deposition. And they will go over the basics of the case with you.

If you’re not represented and you are worried or nervous about attending the deposition without an attorney, you do have a right to hire an attorney but it’s going to cost you money out of your own pocket. There is no right to a court appointed attorney in a civil deposition.
So you can hire your own attorney but it’s going to cost you money.
