Of course, speaking with a lawyer who is in possession of the actual details of the case is the only way to really know whether you have a chance at recovery in any kind of injury case, and that includes when you got hurt on the CTA. I am going to explain a little about the injury claims process that the Chicago Transit Authority has.

You see, CTA bus drivers, train operators and even supervisors who are called to the scene of a crash or an injury will often give you a claims number so that you can call the CTA and open an injury claim.  I have been an injury lawyer for almost 20 years.  Do you know how many time I have heard of an injured person actually being paid anything for their injuries or getting the medical bills paid by making an injury claim through the CTA?

Never.  Not once in almost 20 years.

I think that the CTA claims process is false.  It is a farce.  It is designed to get injured people to give the CTA information about you, your injuries and your medical treatment.  They do this NOT to evaluate your claim for purposes of settling.  Instead, they do it, I believe, SOLELY for the purpose of finding weaknesses in your case.

So they hand out witness cards to other people on the bus, but they do it to find a way to contest your injury case.  CTA lawyers will ask to take a recorded statement from you, but it is mainly to figure out a way to poke holes in your case and get you to say things that you do not even realize hurt your case.  That's why talking to a lawyer who knows what to do when you get hurt on the CTA is the key to improving your chances to win fair compensation for your injuries.

They have lawyers, and you deserve the advice of a lawyer, too.  Why should they get legal advice and you have to go in 'blind', not knowing what they are really doing?  Consult with a lawyer and level the playing field.

Every case is different and there are certain to be wrinkles to the facts of your case that make it somewhat unique.  One simple fact, and knowing how to mitigate it if it is a bad one, can mean the difference between a good outcome or having your case thrown out of Court.  As much as it is unpleasant to think about calling a lawyer, not all lawyers are jerks.  Many of us a very nice people and will spend some time with you on the telephone so you can explain what happened and what your concerns are.  If you have a lawyer who is a jerk, say goodbye and call another one.  Find a lawyer who is courteous and knowledgeable about how to handle such cases as when you call the lawyer and say "I got hurt on the CTA and I need  help..."

Hi guys, in this video we're gonna talk about Chicago motorcycle accidents, and What You Must Know If You Had A Motorcycle Accident In Chicago.

My whole family's been riding motorcycles for as long as I can remember.

My brother and I started riding motorcycles when we were nine or 10 years old. And, for people who've never ridden a motorcycle, they don't realize how unprotected you are.

So if you've been involved in a motorcycle crash, you need to hire a lawyer who knows what it's like to be on a motorcycle, and has seen what other motorists do when they're in the presence of a motorcyclist.

The short answer, of course is, that people don't pay attention to motorcyclists the way they ought to. Motorcycles are smaller than cars or trucks, and unfortunately, people in cars and trucks often don't pay any attention to motorcycles. That's why, I think, sometimes you're safer on a loud Harley Davidson than you are on a quieter motorcycle, or even one of those new electric bikes.

So here are the three things you need to know if you've been involved in a motorcycle crash.

First, hire a lawyer who knows something about motorcycles and motorcycle crash cases. You know, having a lawyer who has experience in the particular area of injury law where you need help is absolutely essential.

Attorneys like that know what to look for and what to avoid, as far as putting evidence in, and they understand that jurors are often very biased against motorcyclists. So hiring an attorney who has some experience in the are of law like motorcycle crashes is very important.

The second thing I wanna tell you is, that it's important to tell your doctor about all your injuries.

A common issue I see in motorcycle crash cases is, that people will talk to their doctor, and, for example, if they have a broken ankle, all of the treatment is focused on the broken ankle.

But, if you have problems with your foot, or problems with your shoulder, or your elbow, or something like that, you have to make sure that the doctor documents those injuries, and addresses them, even though it's natural in medicine for a doctor to treat the most serious injury first. So if you've got a little pain in your shoulder or your elbow, but a fractured ankle, of course the doctor is gonna address the ankle first, but it's important to get all of your injuries documented in the medical records, because otherwise the insurance company will say that maybe your shoulder or elbow injury wasn't related to the crash. So always make all of your complaints to the doctor, and make sure that they get document, even if they defer the treatment.

The third thing you need to know about motorcycle crash cases is, that having a witness is key.

You know, there is prejudice against motorcyclists everywhere you go.

Most people have never ridden a motorcycle, and everybody's been on a road or express way when they somebody on a motorcycle driving like an idiot. Unfortunately, that prejudice affects all motorcyclists, and it's gonna affect you if your case goes in front of a jury, or even a judge. So having an independent witness who says you were driving the speed limit, you were obeying all safety rules, and that it was the other guy, or person, who crashed into you, is really important in a motorcycle crash case.

If you keep this info in mind, you are definitely helping yourself and your case if you got hurt in a motorcycle crash.

Hi guys. Slip and fall injury lawyer Scott DeSalvo here, and in today's video we're going to talk about slip and fall settlements, so stay tuned.

You know, obviously I'm an injury lawyer, so I have lots of friends who are injury lawyers screen slip and fall/fall down cases very carefully.

Why?

Because what's little known is that when you try, or you take a slip and fall case to trial, there's this laundry list of things you have to prove in front of a jury, and some of them are pretty tough to prove.

In a car crash case, all you have to prove is that the crash was the other guy's fault, and as a result, you sustained an injury, and then  show exactly what the injury is.  Not too complicated, though it  is not always easy.

But in fall down cases, you have to prove 6 different things.  I am not going to go into detail as to all of them, becase a couple of the topics are so complicated, they deserve an a book on their own.

That makes slip and fall cases some of the most difficult cases to win. In a normal injury case, all you have to prove is that somebody did something wrong to you, you got injured, and that your injuries relate to what they did wrong to you. That's true in a car accident case and most other kinds of injury cases.

But in a premises liability, which is what lawyers call a fall down case, there's this laundry list of six things we have to prove, and some of them are very difficult.

For example one of the things that you have to prove is that the thing that caused you to fall was unreasonably dangerous, and sometimes, believe it or not, that's sort of hard to prove.

If we're talking about a minor defect in a staircase or on floor, it's not hard to get at least one juror to look at a photo of it and say, "Well, heck, that's not that dangerous. It doesn't look that much different than problems I see in my own house, or what my floors or my stairs look like. That's not unreasonably dangerous."

And remember, if you can't prove all six of those things, you lose your case. In fact, it doesn't even get to a jury. If the judge believes you haven't proved all six things, your case gets directed out on summary judgment.

So, this is going to sound very self-serving, but I will tell you whether you hire me or you hire another lawyer who has lots of experience and really understands premises liability law, the number one thing that is going to make the difference between you recovering money or getting no money is hiring a good lawyering with experience.

I'm telling you, there are ways to handle fall down cases that most general injury lawyers who aren't experienced in premises liability don't even know about. There are ways to make the case about something else, and there are ways to plead the case that make proving your case much easier.  They've never read about it, they've never tried it, they've never studied it.

Make sure you get a lawyer, if you've been involved in a fall, who knows what they're doing.

If you talk to a lawyer and they ask you three or four questions, and they immediately reject your case, they may not be thinking creatively enough about your case.

I've been able to get substantial settlements for several clients in fall down cases that when I initially took the case, I was a little hesitant about. But it turns out that a good lawyering who knows how to screen a premises liability or fall down case can really turn a rough case that other lawyers turn down into a profitable case for the lawyer and a case where you end up with full compensation for your injuries.

Hey, guys. Slip and fall accident lawyer Scott DeSalvo here, and in today's video, I'm going to share some good news with you.

I was able to settle a client's slip and fall case for $142,500 for a broken ankle. Now, that's a great outcome for this kind of case, and in today's video, I'm going to share with you how I got that slip and fall settlement amount for my client.

I always tell my clients, and I've repeated it in a lot of my videos, that slip and fall cases are just tough cases to prove.

They really are. A lot of injury attorneys avoid slip and fall cases for that reason. That's because insurance companies defend them, meaning they usually don't settle them pre-suit before you file a lawsuit. Now, I've litigated a lot of these cases over the years, and I've really learned what to do on the case in order to position them for maximum value. I've gotten pretty good at resolving these cases, but I also don't kid myself.

Lots of lawyers would like you to believe that the lawyer has some magical ability to turn a bad case into a good case, and sometimes we can, but usually it's a matter of taking what we're given in the case and maximizing value.

A good lawyer can sometimes improve sort of a not so great case, but a good case is still a good case, and a bad case is still a bad case, so what did I do in this recent settlement to maximize value and force the other side to come to the settlement table?

First, I was able to show, through government documents, that the stairway my client fell on had been cited by the City of Chicago Building Department several times. Being able to prove that the stairway was dangerous is a key part in proving the case and increasing the slip and fall settlement amount.

Second, I created demonstrative evidence, in other words, diagrams, which showed exactly how the broken staircase caused the fall.

Believe it or not, breaking down exactly how the fall occurred is really important to a jury at trial, but also to the insurance company lawyers. It makes them nervous if we're very good at describing exactly how the problem with the stairs caused the injury.

Third, I personally scoured the medical records for evidence of how severe the injury was, and I looked at medical literature showing that this sort of fracture would probably result in arthritis and could result in future surgery for my client. Doing this sort of research and homework increases the value of the case, and remember, insurance companies settle cases when they become afraid of what will happen at trial.  Simply, you have to think outside of the box and leave no stone unturned to really put together a full picture of the client's injuries and all of the negative consequences and hardships she had to suffer because of the injuries she sustained in the fall.

Now, was this a good case to begin with?  Yes, it was, but the hard work I put into it definitely did two things.

First, it brought the insurance company to the settlement table. Otherwise, they would have taken us to trial, which is always risky.

Second, it increased the slip and fall settlement amount that we were able to get, because the insurance company knew that we had a good theory of liability, how it happened, and we were able to explain all parts of the damages that my client suffered.

Now, every case and injury is different, and hiring a lawyer who is experienced in personal injury lawyer can mean a better outcome for you, but since every case is different, and some cases are stronger than others, you shouldn't take the information in this video as a promise that I'll be able to do the same in your case. If you've been injured, you should consult a lawyer, because there are time deadlines to file a claim or lawsuit, so you should talk to a lawyer immediately.

And I want to be honest with you:  I have handled some real stinkers.  Some of the fall down cases I have helped people with were really hard cases, and some were impossible to prove.  Even then, it is always possible to get a compromise settlement if you position the case properly.

The most common mistake we see in our law practice is people talking to insurance companies and giving a written or recorded statement before they really understand what is happening and what is at stake.

Insurance companies hire a lawyer to help them develop and improve 'outlines' for insurance adjusters to use when interviewing or taking a statement from a witness.

Insurance companies like to take statements from people who have been injured because they want to get the injured person to say something that will later hurt their chances at a fair recovery for a personal injury.  They do this on purpose, and the types of questions and the way they ask the questions are designed to save the insurance company money.

When they talk to you, they sort of pretend that they are just collecting information. That's true enough -- they ARE collecting information.  But the information they are collecting is primarily related to figure out a way to beat your injury case and pay you nothing, no matter how severe the car crash was, or how severe your injuries might be.

The most common kinds of cases where they want to get a statement from you before you can consult with an injury lawyer include car accidents, and slip and fall cases, but they do it I many kinds of case.  In Workers Comp cases, they will often hire an investigator to follow you around and take video of you, hopefully to show that your claimed injuries do not stop you from doing strenuous physical activities.  In other words, they want to show that you are lying or exaggerating.

Injury lawyers give free consultations, and I will be straight with you here:  I tell every one of my clients NOT to give a statement to ANYONE unless I have a chance to talk to them first, and usually, I must be present to represent them during the statement.

This is key because if you say something or get confused and it hurts your case, once you have given a statement, going back and changing an answer affects your credibility.  If a Defense lawyer can call you out over mistakes or inconsistent testimony, then your whole case is in jeopardy.  If a Judge or Jury or Arbitrator does not believe that you are a reliable witness, or that you have a bad memory, or especially that you are lying, your chances at a good outcome go down the drain.

Anytime someone has given a recorded statement before hiring me, my main priority is to get a copy of it.  They are not obligated to give us a copy until we file a lawsuit, and I try to settle cases before filing suit.  So many times, we do not even know exactly what was said until well into the case.  Sometimes, I can fix the problems, and sometimes, the problems really hurt the case.  Be safe and don't give a recorded statement.

Injury and Accident Lawyer Scott D. DeSalvo explains why regular people must arm themselves with injury information to protect their right to recover when they have been involved in a work accident or car accident, or any type of injury.

I self-publish the book and we re-produce the DVD and CD “in house’ at my personal injury law firm to keep costs down and to be able to send them out the injury information ‘on demand’ to people who need this important information to protect themselves and their loved ones if they have been hurt.

The book tells the story of why I became a lawyer and how my father was injured in a serious Workers Comp case, and his case went on for 17 years.  He missed the opportunity to recover more money in a third party personal injury case because of the lawyers he hired.  His bad experience really had a profound negative effect on his life.  He was a victim once, being injured, and for the rest of his life, in addition to his injuries, he felt ‘screwed over’ by the system.
