I’m a little bit depressed today – well, not depressed, a little sad for a person who called me.

You might be able to tell I’m a little bit lower energy than normal. I’m actually shooting this video at home after work, and I wanted to shoot this video because something happened today that I want to tell you about.

I got a phone call from a lady whose husband died. Really nice lady. Really bothered me that she lost her husband, and they’ve got a kid at home, so the child lost his father. She was taking advice from family and friends about not contacting a lawyer. I’ve talked about it in my other videos, there are deadlines for filing lawsuits. These are called Statutes of Limitation.

The problem is, the deadline for your lawsuit depends on the kind of case, who you’re suing, a bunch of circumstances like that.

Her deadline got blown. She didn’t consult with an attorney. She followed family advice and advice from her friends to not get an attorney involved. It ruined my day. I can’t help this lady, and my whole career is focused on helping people who have these sorts of problems, so it really bothers me.

I guess my point is, you’re not going to be able to figure out these deadlines yourself and you’re not going to be able to deal with the insurance companies and the lawyers they hire all by yourself.

Hey, guys. Personal injury lawyer Scott DeSalvo here, and in this video, we're going to talk about personal injury cases against the City of Chicago.

I'm sorry I'm not shooting a live video today, but there are a couple of good reasons for it. One is, I really need a haircut. Second, I've had a very busy week this week, and I just don't feel like getting in front of the green screen and shooting video, but I started running out of topics, and I was going to shoot a Q&A video today, but there's a topic that comes up a lot.

I get a lot of phone calls in my office about people who fall down on a city sidewalk or are otherwise injured as a result of the City of Chicago.

Years and years ago, used to be pretty easy to settle those cases, but it hasn't been for at least 15 or 20 years. They fight the cases, so I wanted to tell you a little bit about one of the cases that I've got that I recently settled. I finally was able to settle it.

I'm not going to tell you the name of the guy who got hurt or exactly where he got hurt, but I'll show you some pictures of what happened. Basically, what happens is, our guy is a baker, and he's on his way to work. He takes the bus to work, and he's walking towards the bus stop, and he's looking down the road to see if the bus is coming, and he trips over road construction signs that are all scattered all over the sidewalk. There's no road construction right in that area, but there's a bunch of road construction signs like laying flat on the ground, presumably from recent work or work that had been done in the area, but there was no work going on at the time, so the implication is that City of Chicago either did some road work or approved somebody to do some roadwork, and they left the signs there.

As our guy's walking towards the bus stop, he trips over one of the signs, and this gentleman didn't have very serious injuries. His medical bills were not that high, and thankfully, after a few months, his shoulder got back to normal, but it was really the principle of the thing. I couldn't get the City of Chicago to give me any information about who put the signs there or whose responsibility it was to clean up their mess, take the signs down and put them where they belong, because a road sign doesn't belong just sitting on the street there.

My guy was willing to say, "Hey, it's 50/50. I'm willing to take some responsibility," but it didn't matter to the City of Chicago.

So on this small case, as a matter of principle, I filed a lawsuit, and I've litigated the case for a year and a half. I've added six or seven or eight additional defendants into the case because the City of Chicago kept playing hide the ball.

Now, look, you know as well as I do that the City of Chicago has recorded as to who was working in the area and who probably left the street signs there, but they weren't helping me. They had no interest in providing me with the information, and finally, by digging and working hard on the case, I was able to find the construction company that sort of admitted that it was their responsibility, and we ended up settling the case for about three times the medical bills, and my client's happy, and I'm happy to have the case over with, because it's a teeny-tiny case that, as a matter of principle, I ended up spending a lot of time on.

What's the takeaway? If you're injured due to the City of Chicago, definitely consult with a lawyer right away, but you have to be ready to be in it for the long haul, because the City of Chicago does not play fair, and they possess all the records and all the information, and they try like hell not to give it to you.

They don't, it's a little ... I'm not going to call it dirty pool. I guess, depending on what your perspective is, if I hurt somebody and I knew I was responsible, I'd fess up to it, but I guess legally, under the state of the law, you can put on a defense which includes trying not to give your opponent evidence.

Today I’m gonna answer the question: What should I do if I have a nursing home case, but it’s got some problems? How should I handle it?

I’m gonna tell you a little about a case that I was just involved in with another attorney, and we were able to settle the case recently.

We had an older gentleman in a nursing home who had lots of breathing problems. He had advanced COPD. He had lots of breathing problems. He would sometimes have worse breathing problems, and then he would get better, and worse, and better.

One morning, he had really bad breathing problems, which was charted in his chart at about 9:00 AM. The nursing home didn’t send him to the hospital until about 2:00 in the afternoon. They were charting serious problems. They didn’t even call his doctor till noon, and then finally got him to the hospital several hours later.

Now, the argument here on our side is obviously when you know you’ve got a patient with breathing problems, and they exhibit more serious breathing problems, you have to call the doctor and get him to a hospital immediately, because you already know his breathing is weak. If there are any problems that manifest, it’s much more serious for somebody with a breathing problem than somebody who’s normal. For example, if I had a breathing problem and I started coughing, you’d take it more seriously than if I never had a breathing problem and then I started coughing and wheezing. You’d jump right on it if I had a preexisting problem with it. They didn’t do that.

The problem here, though, is the weakness in the case was: How do we prove that his passing away was related to the delay in the medical treatment versus just the fact that he was very old, very sick, and had a lot of medical problems?

The problem is in front of a jury, we couldn’t be sure that we had a solid chance to win. Really, that’s when these cases settle, when the defense and the insurance company is afraid that they might get hit at trial, and on our side, we’re willing to compromise.

We were able to get a great settlement in a case, but only because good attorneys who cared about the case and spent two or three years litigating and working on the case put it together and pushed the insurance company into sitting down at the table and talking about a settlement.

So why am I telling you the story?

Well, that’s the advice I’m giving you. It is really important if you or a loved one has suffered nursing home abuse, or a nursing home injury or even a medical mistake to talk to a lawyer who’s gonna do the work.

You need to talk to a lawyer with experience who treats you like a human being, gets the information from you, has open communication with you. Then, it’s gotta be a lawyer who is gonna sit down and really analyze the case and push the case forward.

You know, had we not worked on this case and done a lot of litigation in it before the pre-trial, the defendants probably never would have come to the settlement table. But it’s caring for the patient, caring for the client, and because you care about them, you work hard on the case for them that sends a signal to the insurance company that even in a case with challenges or problems, even with cases you’re not sure that you can win at trial, those are the kinds of cases that you can get to the settlement table and resolve if you’ve got an attorney doing the right thing.

Chicago Lawyer – 3 Things To Know When You Go To The Doctor!

You know, there are three things that you need to be aware of when you receive treatment for your personal injury. I’m going to review those things for you right now.

The First Step

The first thing you have to be aware of is making sure that you have a doctor who is sympathetic to you and is interested in helping you.

Here’s an example:

In workers’ comp cases, a lot of times the company wants to recommend a doctor. If you go to a company doctor, the company doctor is on the side of the company. What the doctor writes in the medical records can affect your case.

Whatever you do, don’t get treated by a doctor who’s aggressive towards you. Make sure you go to a doctor who’s on your side.

The Second Step

Number Two: Make sure you document all of your complaints with your doctor. I see it all the time where somebody will go to the doctor and they’ll complain about their neck. However, they’ll forget to mention that their foot was hurt in an accident.

Well, several months later, they start getting treatment for their foot. At that point, there’s no documentation in the records of a foot complaint until many months after.

The problem here is that it makes it easy for the Defense attorney to imply that you didn’t hurt your foot in the accident. Rather, you hurt it at home or playing a sport and are trying to cash in for an unrelated injury.  

We cannot make these defenses so easy for the insurance company lawyers. Make sure that every visit you go to the doctor, you complain about every part of your body that was injured.

The Third Step

The third thing you need to be mindful of at your doctor’s appointments is this: you have to follow the doctor’s advice.

If your medical record shows that you’ve got many missed appointments or lots of canceled therapy appointments, that sends a clear signal to the insurance company and to the defense attorney.

They can use that information in front of a jury to make it look like you don’t comply with your doctor’s orders. When you miss appointments, you may have a very good reason. But the thing is, the Jury isn’t going to give you a break if you miss a bunch of appointments.  

They think: “If he or she is hurt, why would they miss appointments?” Missed appointments make them think that you are faking or exaggerating your injuries. That’s why I always tell my clients to make all of your appointments and follow all of the doctor’s advice.

If you do these three things, you’re much more likely to have a smooth sailing injury case. Obviously, this isn’t an exhaustive list, but it is a darn good start.

Chicago Injury Lawyer - How Insurance Companies Treat Injured People

In some states, like Florida, if an insurance company refuses to pay anything, even on a valid claim where the injuries are very serious and who caused those injuries is very clear, you can actually take the insurance company directly to court.

You can sue them directly for their bad faith in refusing to make any offer at all, when any reasonable person would know that an offer should have been made.

Attorneys call this a third-party bad faith case.

Like in any case, a judge or jury would hear the evidence and decide whether what the insurance company did was okay or not. But in Illinois, third-party bad faith cases against your opponent’s insurance company are prohibited by law.

In Illinois, insurance companies got their billions of dollars together and made sure that our legislature wrote laws that protect the insurance companies. 

That means that under Illinois law, you can’t bring a third-party bad faith case against an insurance company, even if their claims practices are outrageous, even if they lie to you, they’re rude to you, or they misrepresent things to you.

In fact, even if they refuse to offer you a nickel on a very serious injury or death case. Believe me, insurance companies are taking advantage of this by refusing to pay on valid claims. This is because they know, under Illinois law, they can’t be sued directly.

Because there is rarely any legal consequences for insurance companies and their lawyers for bad conduct, they sometimes try to get away with anything they can. Doing it alone in a personal injury claim is probably a mistake.

Hiring A Lawyer

That is why you should consider hiring a lawyer. Most injury lawyers work on a contingency basis, meaning they only get paid if they win.

In soft tissue injury cases and other kinds of injury cases, you have to be willing to fight. You have to have a lawyer who is willing to go all the way, even if the case is tough.
