Bensenville Medical Malpractice Lawyer

A malpractice case ultimately comes down to one expert doctor against another. Yours reviews the records and testifies that the care fell below the accepted standard; the defense lines up its own physicians to swear it was fine. Whichever side's experts are more credible tends to win. That reality explains everything about how these cases work — why they're expensive, why they take so long, and why the wrong lawyer can't bring one at all.

I'm Scott DeSalvo. For almost 30 years I've handled serious injury cases across DuPage County, and I take medical negligence cases when the evidence supports them. If you or someone you love was harmed by a mistake at a hospital or clinic near Bensenville, here's an honest look at what it takes. The conversation is free.

A Bad Outcome Is Not Automatically Malpractice

This is the distinction the whole case turns on. Medicine carries genuine risk, and good providers sometimes have poor results. Malpractice is narrower: the care fell below the standard a competent provider would have met, and that failure — not the underlying illness or injury — caused your harm. Proving it isn't about how the care felt to you; it's about what a qualified physician concludes after reviewing the records.

Illinois Requires a Doctor to Vouch for the Case First

Under 735 ILCS 5/2-622, you generally can't even file a medical malpractice suit without attaching a certificate of merit — a written report from a qualified health professional who reviewed the case and found a reasonable basis to believe malpractice occurred. Before a judge ever sees the case, a physician has to stand behind it. That keeps groundless suits out, and it forces real money into expert review up front. A lawyer who can't fund that can't properly bring your case.

The Deadline Has a Hidden Second Layer

Most Illinois injury cases run on a simple two-year clock. Malpractice doesn't. You generally get two years from the point you knew, or should have known, that malpractice caused your injury — and behind that sits a hard four-year limit measured from the date of the malpractice, with narrow exceptions and separate rules for children. A late discovery can still run into that four-year wall, which is how strong cases get lost to delay. If you're unsure, ask early.

What Do Real Clients Say About Mr. DeSalvo?

Why the Difficulty Cuts in Your Favor

Most firms turn these cases down because they're costly and hard, not because the medicine was fine — the paid experts, the years of litigation, the deep-pocketed defense. That scares off the field, which means a genuine case brought by a lawyer with the resources to see it through faces less competition than the insurer expects. The strength you need is credible experts and a lawyer prepared to go the distance, backed by almost 30 years of experience and trial training through Gerry Spence's Trial Lawyers College and the Keenan Trial Institute.

What Can Be Recovered, and the Fee

When negligence causes real harm, Illinois law allows recovery for medical costs past and future, lost income and lost earning capacity, physical pain, disability and disfigurement, and the loss of a normal life. The attorney's fee on a malpractice case in Illinois is 33 1/3% of the recovery, and I advance the substantial costs of expert review myself. You pay nothing up front and nothing unless we win.

Bottom line: these are the toughest injury cases to win, so the lawyer you choose matters more here than anywhere else.

Frequently Asked Questions

How do I find out if I really have a case?

Usually only a qualified physician reviewing the records can say for sure, and I can't tell from your account alone. A bad outcome isn't enough — the care has to have fallen below the accepted standard and caused your injury. What I can do is examine what happened and, where it looks serious, have the records reviewed by an expert, which Illinois requires before a case can even be filed.

What's the filing deadline in Illinois?

Generally two years from when you discovered the harm came from malpractice, with a hard four-year ceiling from the date it occurred and separate rules for children. Those two limits interact in ways that are easy to miscalculate, and missing either one ends the case. That's why it's worth asking a lawyer early rather than assuming there's still time.

Why do so many lawyers refuse these cases?

Because they're expensive and hard. Each needs paid medical experts, can take years, and pits you against a well-funded defense. Many firms aren't set up to carry that risk. I take these on when the evidence supports it and give you a straight answer when it doesn't.

What will it cost me?

Nothing out of pocket. I work on contingency at the standard Illinois malpractice fee of 33 1/3%, and I advance the heavy expert-review costs myself. If we don't win, you owe nothing and are never personally responsible for those expert bills.

Can I bring a claim for a relative who died from a medical error?

Yes. When a medical mistake causes a death, Illinois lets the family pursue a wrongful death claim for their loss and a survival claim for what the person endured beforehand, both through the estate's representative. These are among the most serious cases I take, and I handle them with the care such a loss demands.
