Where Exactly Did It Happen?

The first thing that you always have to do in a pedestrian accident is to be clear about exactly where it happened.

This is so important. I get calls from people who are involved in a pedestrian accident or got hit by a car and they don’t remember or didn’t pay attention to exactly where they got hit. Were you in a crosswalk crossing the street?  Or on a sidewalk crossing the driveway?

Ultimately in these pedestrian injury cases, either an insurance company or a jury is going to determine whose fault the accident was.  And, knowing exactly where you were walking or standing when the pedestrian crash occurred is essential in proving the case.

Witnesses?

The second thing you absolutely have to do in a pedestrian accident case in Chicago is make sure you have witnesses.

I can’t tell you the number of injured people who call my office and don’t think to collect witness information.

Why is witness information so important?

In almost every pedestrian injury accident I’ve ever handled my career (and there’s been a lot of them), the insurance company coaches the other guy — the driver of the car of a motorcycle or the truck to say that the pedestrian jumped out in front of the car or that the pedestrian was walking somewhere or standing somewhere that they weren’t supposed to and got hit by a car.

Can you see how having one or two or three witnesses who are on your side about what happened and where it happened can make the difference in your case?

Always collect witness information. Or if you’re with a friend when the accident occurs, ask them to do it.  It is key in being able to prove what happened.

Finally, the THIRD thing you have to do if you’ve been in a pedestrian injury or accident is… DON’T GIVE A RECORDED STATEMENT to the insurance company.

When a motorist hits a pedestrian almost all of them are smart enough to call their insurance company right away then there insurance company calls the person who got hit.

Why do they do that?

Simple.

They want to come to your house have you come to their office or call you on the telephone with a tape recorder and record your version of events.

That doesn’t sound too bad right?

The problem is how you ask questions can determine how a person answers them. The insurance adjuster who calls you will probably ask what is called leading questions when you got hit by a car. These questions are designed by the insurance company to lead you into an answer and if you think the answer that they’re leading you into is going to be good for your pedestrian injury claim, you’re wrong.

Insurance companies hire lawyers to prepare outlines with questions for them. This way they get you on record, and saying things you probably don’t mean before you have an attorney protecting your interests.
