The good news is attorneys fees and workers comp cases are capped at 20% in the vast majority of cases. So in other words, you don’t pay a workers comp lawyer out of your pocket – you only pay a workers comp lawyer 20% of what he or she recovers for you in the case.
Though there are a couple of circumstances where the fee might be more than 20%.
One is for example, when the attorney does a lot of work on your file. He can go to petition the court, in other words, the Commission, and ask for some more attorneys fees based on really going above and beyond. But those fees have to be approved by the Commission.
The other time an attorney might be asking for more than 20% of fees is if you bring the case to the workers comp lawyer with an offer already on the table. Then what will happen is, the attorney will ask you to agree to seize beyond 20% for the amount beyond the offer that they get.
