The Crash Wasn't Your Fault? How To Handle A Car Accident That Wasn't Your Fault and Make Sure That the Responsible Person is Held Responsible.

Nothing is more frustrating than a car accident that was the 'other guys' fault, but someone tried to blame you. If the crash wasn't your fault, then you should not be blamed.  Unfortunately, it happens all the time.

Check out this advice from a seasoned car accident injury lawyer to help you know what to do to.  This way, you will not be blamed and the other driver and his car insurance will be held responsible to pay any damages caused in the car accident.

Why Is It Important?

Who a police officer decides is to blame in a car crash usually determines who gets the traffic ticket for causing the accident.  You do not want a ticket on your driving record if the crash wasn't your fault.

But even more important, if you or a loved one got hurt in the crash, you need to know something important: the person who caused the crash is supposed to be legally responsible for all the injuries and damages caused because of the crash.

If you are marked down as being at fault, the insurance companies are going to want to fight your case to get your car fixed as well as for your medical bills, lost wages, and really the entrie claim.

So making sure the right person gets the blame has a big effect on your injury case, too. We have to make sure the record is straight.  If you get blamed, we have an up hill battle to get your medical bills paid, your lost wages paid, your car repaired, all of it.

Make sure you get to speak with the police officer to tell your side.

Sometimes, police are busy.  Sometimes, they are in a hurry or are having a bad day.

And sometimes, they look at the interesection or the way the vehicles look after the crash and they form a judgment about what happened and who was at fault. They already know what they are doing to write in the report before they talk to anyone.

Even worse is when the police officer only speaks with the other driver if the crash that wasn't your fault.  Thenm the other driver may lie about what happened.  That will lead to you being blamed.

You have to make sure that you have a chance to tell your story to the police officer if the crash wasn't your fault.  This way, you have a better chance to get the other driver held at fault in the police report, which is going to help your car accident injury case later on.

Sometimes after a car accident,  you are unable to speak with tthe police officer. This happens when there is a serious injury or if you leave the scene in an ambulance.  If that happens, go to the police station right away and insist that an additional or supplemental report gets added to the police report.

Don't give a recorded statement to the insurance company without a lawyer.

You should never do this.  Never give an insurance company a recorded statement if you have any sort of injury.  At least, make sure you consult with a lawyer first.

This is especially true if your suspect that you are or might be blamed when the crash wasn't your fault.

Insurance companies use outlined to intervew you about a crash.  The outlines are designed to save insurance companies money. They do that by denying claims.

So do not agree to a recorded statement after a car crash unless you have a lawyer or you at least speak with a lawyer first.  Otherwise, they will trick you into saying something bad for your case and you will end up blamed for the accident.
