Injury Victory in Court!
I represent an older lady who qualifies under the ADA (Americans with Disabilities Act) to get public transportation rides to and from home. She got hurt getting into the vehicle, because, contrary to their own company rules, the driver did not get out of the vehicle and assist.
This is bad enough.
But then, their insurance company lawyer filed a Motion for Summary Judgment, arguing that this specialty transportation service had no “legal duty” to follow their own safety rules. Despicable.
After research, depositions, discovery, and legal briefs, the Judge (a great, experienced judge, by the way) ruled in our favor today over on the Daley Center. My client will get her jury trial in Court.
It feels good when I am able to help folks who do not stand much of a chance against expensive insurance company lawyers who are up to no good. It makes the job worthwhile. It’s why I am a lawyer.
