Can They Fire Me For Filing A Workers Comp Case?

In this article, I answer the question: Can they fire me if I file a worker's comp claim?

You really have to ask yourself, why would you want to continue to work at a place that is going to fire you because you got hurt doing work for them? That's something to think about.

Violates Federal Law

Can they fire you if you file the workers comp claim? The short answer is NO. It violates federal law for them to fire you in retaliation for filing a worker's comp claim. But like most of these things that's actually much more complicated than that.

Retaliatory Discharge Case

I've represented lots of people who frankly were fired after filing a worker's comp claim because the company comes up with a pretext. That's why I tell people who've been involved in a work injury to keep their nose clean at work try to cooperate and try and hang on to that job. Of course if they do fire you and we can prove that it was because you filed a worker's comp claim, that's an entirely different lawsuit and I can help you find a lawyer to evaluate that claim.

I hope this information helped you.
